Nebraska Court Ruling, K.D. & S.L. v. Winterer – State Must Cover ABA For Medicaid-Eligible Children With Autism
A Nebraska judge ruled that Nebraska must pay for autism services - and any other treatments deemed medically necessary - for the state's Medicaid-eligible children on June 30, 2015. The suit challenged a Nebraska Department of Health and Human Services’ (HHS) policy that excludes Medicaid coverage of certain treatments for children with developmental disabilities. The case was filed on behalf of two Nebraska children who were denied coverage for necessary treatments recommended by their doctors, but each have behavioral and mental health conditions . . .
