U.S. v. State of Florida Appeals Court Opinion & Order
On September 17, 2019, the United States Court of Appeals for the Eleventh Circuit its opinion in U.S. v. State of Florida. The appeals court ruled that the US Department of Justice (DOJ) has a cause of action to enforce Title II of the Americans with Disabilities Act (ADA) against Florida for failing to meet its obligations under Title II of ADA and its implementing regulations by “unnecessarily institutionalizing hundreds of children with disabilities in nursing facilities."
