New York Attorney General & Federal Department Of Justice Memorandum Of Understanding For Cooperation On Health Plan Mental Health Parity

On October 5, 2015, the New York Attorney General (NYAG) announced it would work with the federal Department of Labor (DOL) to investigate employer-sponsored health plan violations of the federal and state mental health parity provisions mandated by the federal Employee Retirement Income Security Act (ERISA). The NYAG and DOL entered a five-year memorandum of understanding (MOU), which will enable the two agencies to refer cases to one another, conduct joint investigations into potential violations of law and assist each other with enforcement cases.
