On July 16, 2020, a federal appeals court upheld the administration’s plan to implement site-neutral payments for Medicare outpatient services. The ruling was in American Hospital Association, et al., v. Alex M. Azar, II. Based on this appeals ruling, the Centers for Medicare & Medicaid Services (CMS) will be permitted to reduce reimbursement for outpatient physician services provided by an off-campus provider-based hospital department (PBD) to the same rate paid to independent community-based physicians . . .
