K.G V. Dudek: Lawsuit Concerning Florida Medicaid’s Coverage of Autism Spectrum Disorders

The lawsuit was filed on behalf of Medicaid-eligible children diagnosed with autism. The plaintiffs challenged the Florida Agency of Health Care Administration (AHCA) policy that applied behavior analysis (ABA) treatment was experimental and thus not covered under Medicaid. The court upheld the plaintiffs' position and ordered AHCA to immediately start providing coverage for ABA for Medicaid eligible children diagnosed with autism during the Medicaid Early and Periodic Screening, Diagnosis, and Treatment program.
