Legal Ruling in K.G v. Dudek
March 24, 2012
A Florida judge ruled in favor of the plaintiffs who were diagnosed with autism spectrum disorder but denied applied behavior analysis (ABA) treatment by the Agency for Health Care Administration (AHCA). AHCA argued that ABA was experimental and hence the state Medicaid plan was not required to provide it. However, the judge cited several articles that proved beyond doubt that ABA was an effective treatment and ordered the state of Florida to provide ABA treatment when it is appropriately prescribed by a medical professional.
