The U.S. Commission on Civil Rights (USCCR) recommends that Congress phase-out an exemption to the Fair Labor Standards Act (FLSA) that allows employers to pay less than minimum wage to people with disabilities. Following an examination of the exemption, the USCCR found that the Department of Labor (DOL) and the Department of Justice (DOJ) have consistently failed to provide adequate regulation and oversight, and they have allowed the program to operate without meeting the needs of people with disabilities.
