New DOJ Initiative Targets ‘Worst Nursing Homes’ For Care Quality
On March 3, 2020, the U.S. Department of Justice (DOJ) announced a new “National Nursing Home Initiative” that better coordinates civil and criminal efforts to target nursing homes that provide “grossly substandard care” to their residents. At the time of the announcement, the DOJ had initiated investigations into approximately 30 individual nursing facilities in nine states.
The DOJ intends to consider a number of care failures in identifying the most problematic nursing homes. The criteria for identifying a nursing home that provides grossly substandard care include the following types of care failures:
