New Children’s Bureau Policy Allows States To Claim Legal Support To Children & Parents As Title IV-E Administrative Costs
On December 19, 2018, the Administration for Children and Families (ACF) Children’s Bureau made a policy change to section 8.1 of the Child Welfare Policy Manual that will allow states to claim Title IV-E reimbursement—as an administrative cost—for up to half the cost of providing legal counsel to children and parents involved with the child welfare system. Previously, states and county child welfare agencies were able to claim reimbursement for their own legal fees. Any legal support provided to children and families were entirely state-funded and were not consistently provided across jurisdictions.
