On May 6, 2019, a federal judge confirmed an earlier ruling ruled that Medicare rate cuts to hospitals participating in the 340B drug discount program were unlawful. The judge ordered the federal Department of Health and Human Services (HHS) to develop remedial measures to address hospital cuts made under Medicare outpatient payments for 2018 and 2019.
