FTC Wins Appeal To Halt Penn State Hershey/Pinnacle Health Merger

On September 27, 2016, the U.S. Federal Trade Commission announced that the Third Circuit Court of Appeals ruled that the FTC had a high likelihood of prevailing in its effort to block a proposed hospital merger between Pennsylvania-based Penn State Hershey Medical Center and Pinnacle Health System. The appeals court ordered the district court to enter a preliminary injunction blocking the merger. Hershey Medical Center and Pinnacle Health are reviewing the decision to determine their next course of action. The FTC is continuing to analyze the impact of the merger for the court’s consideration.
