Federal Appeals Court Reinstates ‘Patient Dumping’ Lawsuits By Nursing Home Residents
On July 18, 2019, the Ninth U.S. Circuit Court of Appeals ruled that lawsuits challenging nursing home consumer eviction policies could move forward. The lawsuits were filed by three residents who alleged that the nursing homes' refusal to readmit them after a hospitalization was illegal and constituted "patient dumping." The residents appealed the eviction, and received a state order for readmission. However, they were not readmitted because the nursing homes ignored the orders, and the state failed to enforce the orders.
