CMS Updates Requirements For Nursing Home Arbitration Agreements, Removes Ban On Binding Arbitration
On July 18, 2019, the Centers for Medicare & Medicaid Services (CMS) updated requirements for nursing home and long-term care (LTC) arbitration agreements, and removed a 2016 ban on binding pre-dispute arbitration agreements. This final rule allows LTC facilities to enter pre-dispute arbitration agreements with residents. While the ban has been removed, nursing homes and LTC facilitites cannot require residents to agree to pre-dispute binding arbitration as a condition of admission or remaining at the facility.
