Supreme Court Denies Stay, California Must Continue Reducing Prison Population Pending Appeal
On August 2, 2013, a U.S. Supreme Court justice denied California Governor Jerry Brown’s request for a stay of a previous court order to release 9,600 inmates from the state’s prisons by the end of 2013. The state has appealed the release order to the U.S. Supreme Court; that appeal was filed on August 9, 2013, and had asked the Supreme Court for a stay while the appeal is pending. The denied stay means that the California Department of Corrections and Rehabilitation (CDCR) must continue to release inmates pending the Supreme Court’s decision . . .
