42 CFR Part 2 (42 CFR) is the federal regulation governing the sharing of patient substance abuse information including treatment, referral, and other related activities. Unlike information protected under HIPAA, which can be shared without patient consent for treatment, payment, and health care operations, addiction treatment information sharing is limited to designated provider organizations named by the patient. 42 CFR applies to organizations that are federally assisted and “hold themselves out” as providing addiction treatment.
