CMS Section 1135 Waiver Flexibilities – Coronavirus Disease 2019
On March 27, 2020, the Centers for Medicare & Medicaid Services announced it had approved requests from 34 states for Medicaid waiver requests under Section 1135 to give states tools to respond to the COVID-19 public health emergency declared on March 13, 2020. In certain circumstances, the Secretary of the Department of Health and Human Services (HHS) using section 1135 of the Social Security Act (SSA) can temporarily modify or waive certain Medicare, Medicaid, CHIP, or HIPAA requirements, known as 1135 waivers.
