U.S. Department Of Labor Proposes Minimum Wage For Home Health Workers

The U.S. Department of Labor (DOL) is preparing to issue a final rule on minimum wages and work protections for direct home health care workers providing companionship or live-in care or other services. DOL intends to limit the companionship exemption to the Fair Labor Standards Act (FLSA) to companions employed only by the family or household using the services. Third-party employers, such as in-home care staffing organizations, will not be permitted to claim the exemption, even if the employee is jointly employed by the third-party and a family or household. DOL issued the notice of proposed rulemaking on December 27, 2011 and will accept public comments through March 21, 2012.
