CMS Announces Program to Protect Client’s Assets From Estate Recovery

On July 27, 2006, the Centers for Medicare and Medicaid Services (CMS) announced a “Long-Term Care (LTC) Partnership” program that will allow Medicaid beneficiaries needing long-term care (LTC) to protect their assets from estate recovery. Under the new program, state Medicaid programs may now disregard assets that match dollar-for-dollar the amount paid to an applicant by a private LTC insurance policy when determining if the applicant meets the asset limits for Medicaid eligibility.
