On Petition for Writ of Certiorari to the United States Court of Appeals
for the Eleventh Circuit in re: D.P. v. School Board of Broward
County, Florida
Advocacy group, Autism Speaks, filed an amicus brief in support of
Florida triplets diagnosed with autism who were denied continuing services as they transferred from
coverage under Florida's Early Intervention program to service provided
by their local school district in Broward County. The plaintiff's attorneys argued
that the Individuals with Disabilities Education Act (IDEA) has a
provision of pendency that entitles the children to continued services.
The Eleventh Circuit court originally heard the case of D.P., et al.
v.
the School Board of Broward County Florida and denied this claim. In
January 2008, the Supreme Court upheld this decision.
