Proposed Order & Judgment in Disability Advocates, Inc., v. Paterson, et al.

The United States Department of Justice filed a memorandum in the class action lawsuit Disability Advocates Inc. v. David A. Paterson, et al., supporting the plaintiff's proposed remedy to require 6,000 new community-based placements and against the State's proposal to provide a total of approximately 1,000 new community spaces in the state-run system. On September 8, 2009, a New York judge ruled that the state's reliance on privately run adult homes for people with mental illnesses violated the Americans with Disabilities Act by placing people with psychiatric disabilities in institutional adult homes instead of providing community-based treatment and support.
