ShareClarification Regarding Family Members as Paid  Providers Under North Carolina CAP-MR/DD Waiver

This memo to the North Carolina Legislative Oversight Committee and other North Carolina Department of Health and Human Service stakeholders details how the CAP-MR/DD Waiver will change how family/guardian caregivers may provide care for their family members. In general the new rules are intended to reduce conflicts of interest, improve service quality monitoring, and increase choice for consumers. The rules prohibit the following situations:

  • Guardians who also provide direct care services
     
  • Family or parent caregivers who provide direct care services in excess of 40 hours with in a seven-day period
     
  • Services provided by family or parent caregivers who lack appropriate training or certification
