ShareConsent Order in Doe vs. State of Ohio

Federal District Court Judge John D. Holschuh, for the Southern District of Ohio, Eastern Division, ruled that the Ohio Department of Education (DOE) must abide by the terms of a consent decree in Doe vs. State of Ohio. The terms require DOE to ensure that students with disabilities receive a free and appropriate public education. DOE is required to provide greater oversight of local education agencies, especially those under fiscal or academic emergency or watch. DOE will also keep parents better informed about their local school district performance. If a parent files a complaint, DOE will issue a letter of findings within 60 days; extensions requested by the school district will not be granted, except under extreme circumstances, or if both the parent and school district agree to the extension.
