ShareBrown v. Tennessee Department of Finance & Administration Settlement Agreement

The case of Brown v. Tennessee Department of Finance & Administration, a class action lawsuit filed in August 2000 and settled in 2004, released the agreement between parties. The settlement calls for the state to develop its mental retardation services infrastructure and provider network capacity to support expansion of quality home and community-based Medicaid waiver support services for people with developmental disabilities.

The state was to increase access to services and enter a planning process to expand existing services or develop other waiver programs in order to reduce the number of people waiting for services. The agreement was intended to reduce or eliminate the waiting list for services and is set to expire on December 31, 2009.
