Ohio State Senate Passes Bill (SB 163) on Foster Caregiver Background Checks
On May 7, 2007, State Senator Tom Niehaus introduced a bill that would require law enforcement agencies to link current criminal information with a database of current and prospective foster parents. Included in these background checks would be any person over the age of eighteen living with the primary caregiver. The bill amends current foster care rules and enacts new ones to modify the
notifications that must be given before a child is placed in foster care or if the child has exceptional behavioral needs or has ever committed a felony. It also changes the current law in regard to approval of out-of-home care workers,
adoptive parents, foster parents, and child day cares.
The law addresses funding and payment schedules for the Ohio Department of Job and Family Services.
The senate passed the bill on June 26, 2007. The state house passed a similar bill (HB 213) concerning the establishment of retained applicant fingerprint database for potential and current foster parents. Both of these bills were spurred by the August 2006 death of a developmentally disabled boy at the hands of his foster parents.
