Third-Party Payers v. Eli Lilly & Co. In re: Zyprexa
This page provides links to all three sections of the nearly 300-page
decision to grant class action status to a lawsuit filed by third-party
payers against Eli Lilly and Company for overcharging for Zyprexa, an
antipsychotic medication.
The plaintiffs include pension funds, labor unions, and insurance
companies. The plaintiffs say Lilly overcharged, hid side effects such
as weight gain and diabetes, and encouraged physicians to use the
medication for conditions not approved by the U.S. Food and Drug
Administration (FDA). In addition, the plaintiffs claim that Lilly
violated the Racketeer Influenced and Corrupt Organizations Act (RICO)
through mail fraud. The lawsuit does not question the clinical efficacy
of Zyprexa in its approved uses, despite the presence of metabolic side
effects.
