ShareColbert v. Blagojevich


The lawsuit, Colbert v. Blagojevich, seeks class action status for all individuals with disabilities in the state of Illinois who seek to live in community-based settings. The plaintiffs are five individuals with disabilities who live in nursing homes across Cook County, Illinois. The lead plaintiff was admitted to an Oak Park area nursing facility in February 2006 after complications from surgery left him paralyzed on one side of his body and he started having seizures. The lawsuit seeks the following:

  • Mandatory admission assessment and periodic assessments to determine if nursing home residents are eligible for community-based services
     

  • Free access to information about alternative home and community-based care options
     

  • On-going support for nursing home residents who are able and interested in transitioning to live in the community
