Draft OIG Compliance Program For
Pharmaceutical Manufacturers
The federal Department of Health
and Human Services Office of Inspector General (OIG) released a
draft compliance program for pharmaceutical manufacturers on
September 30, 2002, stating that many of the practices commonly
used in the marketing and sale of prescription drugs could be in
violation of federal fraud and abuse laws. Issued as a guidance to
the pharmaceutical industry, the new standards specifically state
that drug makers can not offer incentive payments or other
"tangible benefits" to encourage or reward the
prescribing or purchase of particular drugs by doctors, health
plans or companies that manage drug benefits for employers and
insurers.
