Court Order in E.H. v. Matin, Requiring West Virginia to Seek a Medicaid Waiver for TBI Services
The West Virginia Department of Health and Human Resources (DHHR) submitted a Medicaid waiver to provide home- and community-based services for persons
with traumatic brain injuries (TBI). The waiver was submitted as the outcome of a court order issued in 2009. DHHR had appealed the order; the state Supreme Court
denied the agency's appeal of the order .
