ShareSettlement in United States v. State of Nebraska, Beatrice State Developmental Center

On June 30, 2008, the Nebraska Department of Health and Human Services and the U.S. Department of Justice reached a settlement regarding the care given to people served at Beatrice State Developmental Center (BSDC). In return, federal officials will not prosecute and will not fine the state. The settlement will include up to four years of court monitoring. An independent expert, John J. McGee, Ph.D., of Omaha, will be appointed to monitor the progress and report monthly to the U.S. District Court.

As part of the agreement the state will follow a plan outlined in March 2008. The plan, and progress as of the date of the settlement, hinges on reducing the number of BSDC residents from about 255 clients on June 30 to 200 clients by December 31, 2008.
