Barkowska vs. Blue Cross Blue Shield of Michigan and Michigan Education Special Services Association

On July 22, 2010, a class action lawsuit was filed against Blue Cross Blue Shield of Michigan (BCBSM) for failing to authorize payment for applied behavior analysis (ABA) treatment for children with autism. The complaint, Barkowska vs. Blue Cross Blue Shield of Michigan and Michigan Education Special Services Association, alleged that BCBSM has continued to classify ABA therapy as experimental and has orchestrated a company-wide policy to unduly hamper processing of claims for ABA. The proposed class represented by the lawsuit includes all governmental employees with children who received ABA treatment for autism. A hearing date in 2010 was anticipated.
