ShareCalifornia Senate Bill No. 1137

This bill, which was signed by Governor Arnold Schwarzenegger, would make changes to the Substance Abuse and Crime Prevention Act of 2000, which is also known as Proposition 36. A key change would authorize courts to order incarceration for a specified period in order to enhance treatment compliance, and in some circumstances, to order the defendant to enter a residential drug treatment program, if available, or be placed in a county jail for not more than ten days for detoxification purposes only. The legislation has been blocked from implementation following a legal action filed July 12, 2006.
