ShareAgreement to Terminate Lawsuit David C. v. Leavitt

After 14 years of federal court supervision, Utah's Division of Child and Family Services (DCFS) and the National Center for Youth Law (NCYL) have agreed to end the lawsuit David C. v. Leavitt. The 1993 suit was filed by NCYL over unconstitutional conditions in Utah's foster care system, including unsafe foster homes, inadequate foster parent and case worker training, and lack of basic health care. The parties to this lawsuit made the following agreements and acknowledgements:

  • Significant reforms to Utah's child welfare system have been achieved

  • Defendants have made significant progress in improving case practices and ensuring strong system performance

The case will be permanently dismissed as of December 31, 2008.
