ShareQuestions & Answers About the Association Provision of the Americans With Disabilities Act

The association provision of the Americans with Disabilities Act protects applicants and employees from discrimination based on their relationship or association with an individual who has a disability. The provision is applicable whether or not the applicant or employee has a disability. The provision was put into effect so that employers would not discriminate or take unwarranted action upon an employee based on stereotypes about individuals who associate or have relationships with people who have disabilities.

The questions and answers document about the association provision addresses questions about closeness of relationship, types of conduct prohibited, required accommodation due to relationship, and insurance coverage. The document also includes examples of each situation as well as legal enforcement and retaliation provisions.
