KC v. North Carolina DHHS, et al.,  Regarding Medicaid Supports Determinations for Persons With Developmental Disabilities

On July 5, 2011, a coalition of advocacy groups filed a federal lawsuit seeking class action status against the North Carolina Department of Health and Human Services (DHHS) and Piedmont Behavioral Health (PBH) over Medicaid cuts to developmental disability support services based on a new service determination system. The plaintiffs in K.C. v. DHHS, et al., claim that PBH and DHHS failed to follow proper appeal processes for four persons with severe disabilities whose services were eliminated or reduced by PBH after using a new level of need determination tool, the Supports Needs Matrix.
