Risinger v. Concannon &
Duby (Civil No. 00-116-B-C) U.S. District Court Decision
Details the background and decision
of a class-auction lawsuit filed in Bangor in July 2000, where two
Augusta-area families alleged that the state failed to meet
standards of care for their children that are required under
federal law. The families of Jill Risinger, and Eric Fitzpatrick
claimed that the state failed to provide "timely, adequate,
and reliable" services required by state and federal law.
Rather than seeking monetary damages, the families asked the court
to mandate systemic reforms. On July 2, 2001, U.S. District Court
Judge Gene Carter ruled that all children with mental impairment
who were not receiving timely in-home services from the state
would become plaintiffs.
