Memorandum & Order in Reynolds v. Commonwealth of Pennsylvania

This report summarizes the detailed memorandum and order on the case of Reynolds v. Commonwealth of Pennsylvania. On June 21, 2010, a Scranton, Pennsylvania judge ruled that the Pennsylvania Board of Nursing (PBN) must answer a lawsuit alleging that the organization has an unwritten policy prohibiting licensure for nurses receiving methadone treatment for chronic opioid addiction. PBN has required nurses in recovery to prove that they have been "weaned" from methadone. The judge said the requirement violated Title II of the Americans with Disability Act (ADA). The ruling has enabled the lawsuit to move forward.
