Michele Haddad v. Florida
A brief by the United States Department of Justice (DOJ) was filed in support of a lawsuit,
Michele Haddad v. Florida, against the state of Florida. The lawsuit
challenged Florida's policy of withholding waiver services for persons with
brain or spinal cord injuries unless they entered a nursing home for 60 days.
Florida had refused to provide community-based services without the plaintiff
being institutionalized which violated the Americans with Disabilities Act. The
plaintiff was granted a preliminary injunction.
