SEIU 1199 ResCare Settlement Agreement & Notices

In response to a complaint filed by ResCare group home employees in West Virginia who sought to opt-out of membership in the Service Employees International Union (SEIU) local 1199, the National Labor Relations Board negotiated this settlement agreement. The union was not charged with breaking any laws. Union officials agreed to mail notices to all ResCare employees in West Virginia explaining employees' rights to opt-out of full-dues paying union membership. SEIU mailed the letters on May 24, 2010, to about 1,200 ResCare employees. Nonmembers will not be required to pay union dues that are allocated for activities unrelated to collective bargaining such as political activism, lobbying, and member-only events. Union dues paid by about 200 ResCare employees in Mercer County, West Virginia, have been refunded to those who rescinded their union memberships.
