 CMS Memo About Use of Binding Arbitration in Nursing Homes
In this memo, the Centers for Medicare and Medicaid Services (CMS) defers to state laws on
binding arbitration. It notes that if a nursing home discharged a resident or retaliated due
to a residents failure to sign a binding arbitration agreement, the state could initiate
enforcement action based on violation of the rules governing resident discharges or transfers.
