New Jersey DDD Amended Eligibility Rules
This proposed amendment will allow additional individuals to be
served by the New Jersey Division of Developmental Disabilities.
Previously, individuals who had a mental or physical impairment that
manifested before the age of 22, but did not have substantial
functional limitations in three or more of the areas of major life
activity until after the age of 22, were not eligible for services.
Following the New Jersey Supreme Courts decision in T.H. v.
Division of Developmental Disabilities they are eligible. This
proposed amendment memorializes the Supreme Courts decision.  |
