DOJ Findings Letter to New Hampshire Department of Health and Human Services Regarding Mental Health Services

On April 7, 2011, the United States Department of Justice (DOJ) told New Hampshire that the mental health system violated the Americans with Disabilities Act (ADA) because it fails to provide services in the most integrated setting possible for the individuals. DOJ started its review in November 2010; it evaluated the adequacy of community-based mental health services and found that the state has failed to develop community service capacity and supported housing, leading to a high risk of institutionalization at the 202-bed New Hampshire Hospital (NHH), the 114-bed Glencliff Home, or incarceration in state prisons or county jails. Additionally, the lack of sufficient community capacity has prevented discharge from NHH and Glencliff to more integrated community-based settings.
