ShareVirginia Senate Bill 247

This bill enables parents to commit their children for crisis mental health treatment.

  • Minors (aged 14 or older) may be admitted to a state hospital, community services board, or behavioral health authority without that minors consent by their parents.

  • Requires a mental health screening within 24 hours of containment to determine whether or not the minor is any danger to himself or others, if he is in need of inpatient treatment, and whether or not that treatment is the least restrictive option.

  • Within 72 hours of containment, a subsequent commitment hearing will be held by a local court to make the final determination if the minor should be detained for 90 days or released back into parental custody.
