Washington State House Bill 2078: Concerning Persons With Developmental
Disabilities who Are in Correctional Facilities or Jails
This bill was introduced February 9, 2009. It
proposes changes that will permit the state to ensure that individuals
with developmental disabilities who commit crimes receive reasonable
accommodations while incarcerated. The state Department of Social and
Health Services has proposed a five-phase model for reinstating medical
assistance eligibility for any person who was receiving medical
assistance at the time of incarceration.
The bill's provisions would start by January 1, 2011. The bill specifies
that reasonable accommodation includes:
Early identification of inmates with developmental disabilities during
booking
Continuation of medical services during incarceration
Transition programs to upon release
