Complaint Filed in Berge vs. United States

The lawsuit was filed on behalf of United States military and retired military families who have children diagnosed with autism. The plaintiffs have challenged the U.S. Department of Defense health care policy of classifying applied behavior analysis (ABA), a technique used to correct or mitigate problem behaviors common with autism, as an educational intervention, not a medical intervention. The plaintiffs noted that many states that have passed laws requiring health insurance plans to cover ABA as a medical intervention for children with autism.
