ShareOregon DHS Children, Adults & Families Self-Sufficiency Programs Draft Administrative Rules

On April 1, 2008, the Oregon Department of Human Services will implement a strict new Medicaid estate recovery rule that will enable the state to place a lien on a beneficiary's home to recover the costs of long-term care. It will enable the DHS Office of Payment Accuracy and Recovery to review inter-spousal assets or home title transfers that take place up to five years prior to an individual's application for Medicaid eligibility. Currently, only North Dakota and Minnesota have similar rules.
