Blackman v. District of Columbia
Blackman et al., v. District of Columbia, is a 1997 class action
lawsuit brought on behalf of children needing special education services
from the District of Columbia Public Schools (DCPS). The plaintiffs
alleged that DCPS failed to provide adequate special education services;
in particular failing to conduct timely special education due process
hearings and failing to implement the hearing determinations in a timely
manner. In December 2005, the plaintiffs and DCPS entered into a Consent
Decree that was approved by the court in June 2006. The December 10,
2007, agreement is a response to an Alternative Dispute Resolution
process initiated by the plaintiffs on July 6, 2007, because DCPS had
missed deadlines to comply with the terms of the Consent Decree. DCPS has
agreed to improve the Districts special education programs; the plans
call for additional mental health services and case coordination, as well
as more educational services.
