ShareCalifornia Department of Aging Letter About Court Injunction on Changes to Adult Day Health Care Services

On February 24, 2010, a federal judge granted a preliminary injunction that prevented the California Department of Aging from imposing changes to eligibility criteria for Medicaid-funded adult day health care (ADHC). DSS had proposed new eligibility criteria that would have made from 8,000 to 15,000 ADHC consumers ineligible as of March 1, 2010. The judge ordered DSS to continue using the former eligibility criteria and Individual Plan of Care. ADHC is a center- based program that provides therapies, medical monitoring, and social services for low-income individuals at-risk of needing institutional care.
