ShareChambers et al. v. San Francisco

The lawsuit, Chambers et al. v. San Francisco, originated in October 2006 on the claim that residents at Laguna Honda who had been found able to live independently were still being confined at the facility. The plaintiffs argued that this was a violation of a provision of the Americans with Disabilities Act that requires those with disabilities be provided services in the most integrated setting appropriate to their needs. The case was brought by Protection and Advocacy, Inc., Disability Rights Education and Defense Fund, the AARP Foundation Litigation, the Bazelon Center for Mental Health Law, and the law firm of Howrey LLP on behalf of six Laguna Honda residents and the Independent Living Resource Center of San Francisco.

A November 27, 2008, preliminary settlement agreement, which includes the Citys creation of 500 units of independent subsidized housing over the next 5 years for persons with disabilities. Those eligible for the new housing units are persons who live, who have been discharged within the last 2 years, or who are awaiting placement at the 1,100-bed Laguna Honda nursing home.
