Minnesota House File 359
Minnesota House File (HF) 359 was introduced on January 29, 2009; companion legislation Senate File 312 has been introduced to the Senate. The bills require private health insurance companies to provide coverage for the diagnosis and treatment of autism spectrum disorder; no age limit was stated. The maximum annual benefit was not stated. Coverage must be provided for treatments provided or ordered by a licensed physician or a licensed psychologist who determine the care to be medically necessary. Covered treatments include: diagnosis, habilitative or rehabilitative care, pharmacy care, psychiatric care, psychological care, therapeutic care, and ABA. In addition, the bill calls for the Minnesota Department of Health to adopt rules establishing standards for qualified autism service providers. After the adoption of these rules, payments will only be made to providers that meet these standards. The provisions of the bill apply only to fully-funded health plans governed by the state. If approved as proposed, the provisions would take effect on August 1, 2009.
