In August 2001, the
Centers for Medicare and Medicaid Services (CMS) delayed the
implementation of a January 2001 final rule establishing new
consumer protection and quality assurance requirements on Medicaid
managed care programs. These regulations resulted from enactment
of the Balanced Budget Act of 1997 (BBA). Subsequently, CMS
published a notice of proposed rulemaking, indicating its
intention to revise this rule. The public has until October 19,
2001 to submit comments on the proposed rule to the Department of
Health and Human Services. A new final rule will likely be
published following consideration of the latest round of public
comments. More than four years after the BBA was enacted, Medicaid
beneficiaries are still waiting for the consumer protections the
Congress established.  |
